MTS has started to have legal proceedings with "Euronetwork" because of iPhone
The first round of proceedings between MTS and "Euronetwork" which have terminated relations in April, was won by the operator.
The court has decided to collect from "Euronetwork" of 272,3 million rbl. of debts on put iPhone
Despite cancellation of the contract with the largest Russian network of salons of communication (3700), MTS share on subscribers in Russia for three months has not decreased, and even has slightly grown. According to research company AC&M Consulting, in the end of March it made 34,1 %, and in the end of June – 34,3 %.
Yesterday the Arbitration court of Moscow has satisfied MTS claim, having decided to collect from "Euronetwork" of 272,3 million rbl. of debts by put phones iPhone, the president of "Euronetwork" Alexander Malis has told to "Sheets". The representative of MTS Elena Kohanovskaja has confirmed it, having refused to specify a detail. According to Malisa, "Euronetwork" will appeal, but if the definitive decision is not in favour of "Euronetwork" she will "by all means pay.
The court has accepted obespechitelnyie measures under this claim, but one of these days "Euronetwork" has challenged them, having given a bank guarantee.
This first decision on a series of claims with which have exchanged MTS and "Euronetwork" since April after MTS has broken off the contract with "Euronetwork", having referred to a cooperation inefficiency. Then MTS has submitted the claim not only for deliveries iPhone, but also on debts on reception of payments from subscribers — for 322,6 million rbl. "Euronetwork" has submitted counterclaims on 499,1 million rbl. Then MTS has made additional demands — on $14,075 million on advance payment for sale of contracts, and "Euronetwork" has addressed in arbitration with the request to recognise as void dogovoryi from MTS about delivery iPhone and purchase of sim cards. In the claim it is a question of the same contract on iPhone, the court did not begin to unite two manufactures in one, is perplexed Malis.
