Associated Press has won court at news agregatora All Headline News
Suit Associated Press (AP) against All Headline News (AHN), mentioning intellectual property infringements, has come to the end with signing of the agreement in favour of the largest news agency. Accused were obliged not to abuse henceforth use of materials AP, and also to pay to claimants not named sum as indemnification, it is informed in victorious press release AP.
The agreement became logical end of the process begun in January, 2008. As the judicial claim submitted lawyers AP affirmed, that employees online-agregatora of news AHN, following the instructions received from a management, copied news messages AP, cleaned from them the information on authorship and a copyright, replacing with their then published on the services.
It is curious, that lawyers AP have managed to convince court to qualify these actions as infringement of a so-called principle of "latest news" — the legal theory accepted by the Supreme court of the USA still in shaggy 1918. This principle allows news editions to have legal proceedings with competitors for a reprint of materials, "sensitive by time", and, that is characteristic, out of any communication with copyrights.
In AHN have tried to reject charges, having noticed, that the given principle cannot be applied for the reason, that in 1976 it was actually replaced with the Law on the copyright. However in February of this year the court has decided, that the principle of "latest news" still is suitable in Internet our century. Eventually, in AHN have decided to stop to flutter and have settled a question the agreement of lawsuit.
Let’s remind, that agency AP in the last has seriously attended some months to a problem of larceny of the content and develops technology which will allow to reveal quickly on-line kopipasterov for the further trials.
